SMS Terms and Conditions and Privacy Notice

These SMS Terms and Conditions and Privacy Notice (“SMS Terms”) govern the text messaging service provided by Forty Two Inc and its affiliates (“Forty Two,” “we,” “our,” or “us”).
By opting in to or using our text messaging service, you agree to these SMS Terms and our General Privacy Policy.
1. Description of the SMS Service
Forty Two uses text messaging for low-volume, one-to-one conversations between our employees and customers.
Messages may concern:
- Event planning and production updates
- Event schedules and timing
- Venue access and on-site logistics
- Audiovisual or equipment requirements
- Service confirmations and requested changes
- Questions needed to coordinate or complete an event or service
- Customer-support matters
Messages may occasionally contain links or telephone numbers relevant to an event, project, or requested service.
This SMS service is not used for bulk messaging, third-party advertising, lead generation, or automated marketing campaigns.
2. Opting In and Consent
You may opt in by texting START to a Forty Two SMS-enabled telephone number after receiving instructions from Forty Two through our website, an event document, a proposal, a contract, or direct communication with one of our employees.
By texting START or otherwise expressly consenting to the service, you authorize Forty Two to send conversational text messages to the mobile telephone number you use to opt in.
Consent to receive text messages is not a condition of purchasing goods or services from Forty Two.
You represent that you are the subscriber or customary user of the mobile telephone number provided and that you are authorized to consent to receiving messages at that number.
3. Message Frequency
Message frequency varies. The number of messages you receive will depend on your event, project, service needs, and your conversations with Forty Two employees.
4. Message and Data Rates
Forty Two does not charge a separate fee for this text messaging service. However, message and data rates may apply under your wireless carrier’s plan. Contact your wireless carrier for information about your messaging and data plan.
5. Opting Out
You may opt out at any time by replying STOP to the Forty Two telephone number from which you received a message.
You may also use one of the following supported opt-out keywords:
QUIT, END, REVOKE, OPT OUT, CANCEL, or UNSUBSCRIBE
After opting out, you may receive one final message confirming that your request was processed. You will then receive no further messages from that telephone number unless you opt in again by replying START.
Because this service consists of conversations with individual Forty Two employees, an opt-out request applies to the specific SMS-enabled telephone number to which you send the request.

7. SMS Privacy Notice
Forty Two respects your privacy. We use information provided through the SMS service to communicate with you, respond to your questions, coordinate events and services, provide support, and maintain appropriate business records.
We may share information with service providers that help us operate the SMS service, including messaging-platform providers, telecommunications carriers, and vendors that transmit or support the delivery of messages.
Mobile information, including telephone numbers, SMS opt-in data, and consent records, will not be shared with third parties or affiliates for marketing or promotional purposes.
We do not sell SMS opt-in information. We may disclose information when reasonably necessary to comply with applicable law, regulation, legal process, or governmental request; protect the security of the service; prevent fraud or misuse; or protect our rights and property.

8. Service Availability
Text-message delivery is subject to effective transmission by your wireless carrier and is not guaranteed. Messages may be delayed or undelivered because of circumstances outside Forty Two’s control. Wireless carriers are not responsible for delayed or undelivered messages.
The SMS service may not be available through every carrier, device, or geographic area.
9. Changes to These SMS Terms
We may update these SMS Terms periodically. Updates will be posted on this page with a revised effective date. Your continued use of the SMS service after an update constitutes acceptance of the revised SMS Terms.
