1. Overview – Limited Warranty Statement
Forty Two Inc. (“Forty Two,” “we,” “our,” or “us”) provides limited warranties on eligible purchases to ensure reliable performance and fair remedies if issues arise. Our warranties cover defects in materials and workmanship under normal use and service as outlined here. They do not cover misuse, abuse, unauthorized modifications, normal wear and tear, power anomalies, acts of God, or third-party negligence.
Unless otherwise stated in a signed agreement, warranty terms commence on the earlier of (a) delivery, (b) installation completion, or (c) service completion. Manufacturer warranties (“OEM warranties”) apply to equipment purchased through Forty Two; where applicable, we act as your warranty liaison with the OEM.
2. Systems Integration, Installation, and Sales
2.1 Scope of Coverage
- Labor & Workmanship Warranty – Installation workmanship is warranted to be free from defects for 90 days from substantial completion.
- Equipment Warranty – Installed equipment is covered exclusively by the OEM’s factory warranty per the manufacturer’s terms. Typical periods for common brands appear below.
- Warranty Liaison Support – During the OEM warranty, Forty Two will coordinate claims (diagnosis and shipping coordination) at no charge for the first two (2) on-site hours per claim; additional time is billed at standard rates unless covered by a Forty Two Extended Service Plan.

2.2 Exclusions
- Consumables (e.g., lamps, batteries, filters, projector bulbs, cables).
- Client-supplied or previously installed equipment not purchased through Forty Two.
- Damage from improper use, relocation, environmental conditions, or unauthorized service.
- Software updates or configuration changes outside the contracted scope.
3. Production Services
3.1 Scope of Coverage
- Operational Assurance – All equipment supplied for the production will be in good working order at the start of the contracted event period.
- On-Site Service – If equipment fails during an event, Forty Two will make reasonable efforts to repair, replace, or provide an alternative to continue production.
- Crew Performance – Forty Two crew will perform with professional skill and care consistent with industry standards.
3.2 Limitations
Coverage applies only during the contracted event period and excludes force majeure, venue power or connectivity failures, or issues with client-provided equipment or media.
4. Rental Services
4.1 Scope of Coverage
- Equipment Condition – Rented gear is warranted to be in good operating condition at pick-up/delivery.
- Defect Remedy – For failures under normal use, Forty Two may (at its discretion) replace with a comparable unit or issue a rental credit for the affected period.
4.2 Exclusions
- Damage from misuse, negligence, or failure to follow instructions.
- Unauthorized repairs, opening, or modification.
- Loss, theft, or damage beyond repair (renter is financially responsible).
5. Warranty Claims Process
- Contact support by email, by phone at (330) 799-2108, or submit a ticket at support.fortytwo4u.com within the applicable warranty period.
- Provide your invoice/PO, serial numbers (if applicable), and a detailed description of the issue.
- Allow reasonable access for diagnosis. We will confirm whether the issue is covered.
- For covered claims, repairs/replacements will be provided per this policy and the OEM’s terms.
6. Limitations of Liability
This Limited Warranty is exclusive and replaces all other warranties, express or implied, including merchantability or fitness for a particular purpose. Forty Two’s total liability is limited to the original purchase price of the product or service. In no event shall Forty Two be liable for incidental, consequential, special, or indirect damages (including lost profits or downtime).
7. Extended Coverage Options
- Extended labor coverage beyond OEM term
- Priority response SLAs
- Scheduled preventative maintenance
- Remote monitoring and diagnostics

8. Dispute Resolution & Governing Law (Ohio)
8.1 Good-Faith Negotiation
The parties will attempt in good faith to resolve any dispute, controversy, or claim arising out of or relating to this Limited Warranty through informal negotiations before initiating legal action.
8.2 Mediation (Mahoning County, OH)
If the dispute is not resolved within 30 days after written notice, the parties agree to submit the matter to non-binding mediation before a mutually selected mediator in Mahoning County, Ohio. Mediation costs are shared equally.
8.3 Venue & Jurisdiction
If mediation does not resolve the matter, any legal action shall be brought exclusively in the state or federal courts located in Mahoning County, Ohio, and the parties consent to the jurisdiction of those courts.
8.4 Waiver of Jury Trial
To the fullest extent permitted by law, the parties waive the right to a trial by jury in any action or proceeding arising out of or relating to this Limited Warranty.
9. Miscellaneous
- No Assignment of OEM Obligations – OEM warranties are provided by the manufacturer; Forty Two is not responsible for OEM obligations beyond liaison support where stated.
- Entire Agreement; Changes – This policy may be updated by posting a revised version; changes apply prospectively. Any additional written warranties signed by Forty Two will control in the event of a conflict.
- Severability – If any provision is held invalid, the remainder remains in effect.
This policy is intended for commercial and professional users and may be incorporated by reference into project proposals, MSAs, service orders, and rental agreements.
