Forty Two Inc. (“Forty Two,” “we,” “us,” or “our”) respects the intellectual property rights of others and expects users of its websites and services to do the same. Pursuant to the Digital Millennium Copyright Act of 1998 (“DMCA”), we will respond to properly submitted notices of alleged copyright infringement occurring on or through our digital platforms.

1. Notification of Claimed Infringement

If you believe that your copyrighted work has been copied or made accessible in a way that constitutes copyright infringement, you may submit a written DMCA notice to our Designated Agent. The notice must include:

  • A physical or electronic signature of the person authorized to act on behalf of the owner of the copyright interest

  • A description of the copyrighted work that you claim has been infringed

  • A description of where the allegedly infringing material is located on the website, including the URL or other identifying information

  • Your address, telephone number, and email address

  • A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law

  • A statement by you, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner

2. Counter-Notification

If you believe that material you posted on our site was removed or access to it was disabled by mistake or misidentification, you may submit a counter-notification. The counter-notification must include:

  • Your physical or electronic signature

  • Identification of the content that has been removed or to which access has been disabled, and the location at which the content appeared before it was removed or disabled

  • A statement under penalty of perjury that you have a good faith belief that the content was removed or disabled as a result of mistake or misidentification

  • Your name, address, telephone number, and email address

  • A statement that you consent to the jurisdiction of the federal court in Mahoning County, Ohio and that you will accept service of process from the person who submitted the original DMCA notice or their agent

Upon receipt of a valid counter-notification, Forty Two may restore the content in question unless the original complainant files a court action seeking to restrain you from engaging in the infringing activity.

3. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, Forty Two may, in appropriate circumstances and at its sole discretion, terminate accounts or access for users who are deemed to be repeat infringers.
