At Forty Two Inc. (“Forty Two,” “we,” “us,” or “our”), we are committed to responsible sourcing practices throughout our supply chain and to compliance with applicable laws and regulations, including Section 1502 of the Dodd-Frank Wall Street Reform and Consumer Protection Act, which addresses conflict minerals.

1. Policy Overview

“Conflict minerals” refer to tin, tantalum, tungsten, and gold (“3TG”) sourced from the Democratic Republic of the Congo (DRC) or adjoining countries, where the trade in such minerals may directly or indirectly finance armed conflict or human rights abuses.

Forty Two is committed to ensuring that our products, where applicable, do not contain conflict minerals that benefit armed groups. We expect our suppliers to share this commitment.

2. Supplier Expectations

We require our suppliers to:

  • Conduct due diligence on the origin and chain of custody of 3TG in accordance with the OECD Due Diligence Guidance for Responsible Supply Chains of Minerals

  • Provide accurate and complete information regarding the use and sourcing of 3TG in products, components, or materials supplied to Forty Two

  • Adopt policies and management systems to support compliance with conflict-free sourcing requirements

  • Cooperate with Forty Two’s efforts to track the use and origin of conflict minerals in our supply chain

3. Risk Mitigation

If a supplier is found to be non-compliant with this policy or to be sourcing minerals that support conflict or abuse, Forty Two will take appropriate corrective action, which may include terminating the business relationship.
